Terms & Conditions

Welcome to openrun.ae (“Website”). These Terms & Conditions (“Terms”) are a binding agreement between you and Team 42 L.L.C-FZ (“Team 42”, “we”, “us”, “our”), the operator of the Open Run results platform in Dubai, UAE. By using the Website or taking part in any Open Run run (a “Run”), you agree to these Terms. If you do not agree, do not use the Website or attend Runs.

1) Definitions

  • Run: any run, training session, meet-up, warm-up, briefing, or similar activity under the Open Run name.
  • Participant, you, your: any person using the Website or attending a Run.
  • Results: names, times, distances, heart-rate data, VO2max estimates, rankings, and related performance data.
  • Content: text, images, video, audio, data, or other material on the Website or submitted to us.

2) Eligibility

  • You must be 18+ years old. If under 18, a parent/legal guardian must be present and responsible for you.
  • You must be fit to run and free from any condition that makes participation unsafe. Ask a medical professional if unsure.
  • Comply with UAE laws and any venue/authority rules at all times.

3) Registration & Attendance

  • First-time Participants must register and provide accurate details. Keep your information up to date.
  • Runs are free unless we clearly state otherwise. We may limit capacity, require pre-registration, or decline participation.
  • Follow all on-site instructions from organizers/volunteers, including warm-ups, route guidance, briefings, and any cut-off times.

4) Health, Safety & Assumption of Risk

  • Risks. Running involves risks, including falls, collisions, dehydration, heat stress, cardiac events, and interactions with other park users or vehicles. You knowingly accept all such risks.
  • Preparation. Hydrate well and dress for the weather. A chest heart-rate strap is recommended for better accuracy.
  • Etiquette. Be aware of the surface and other users. Keep right where appropriate, signal when overtaking, and respect signage and instructions.
  • Emergencies. If you feel unwell or are injured, stop and seek help. You consent to basic first aid and to sharing necessary information with emergency services.

5) Waiver, Release & Indemnity (Injury/Death)

By taking part in any Run, you assume all risks associated with running and related activities and you release, discharge, and hold harmless Team 42, its officers, employees, and volunteers from any and all liability, claims, demands, or causes of action for injury, illness, or death and for damage or loss of property arising out of or connected with your participation, except to the extent caused by our gross negligence or willful misconduct. You also agree to indemnify and defend Team 42 against third-party claims arising from your breach of these Terms or your negligent, reckless, or intentional acts. We are not responsible for lost, stolen, or damaged items.

6) Timing, Results & Leaderboards (Publication)

  • Self-timing. Unless stated otherwise, timing is self-recorded on your watch/app. Submit your time and any required evidence as instructed (e.g., screenshot, public link).
  • Publication. You agree that your name, time, and Run statistics may be published on openrun.ae and our social channels, and may be used to produce rankings, trends, and VO2max/pace estimates.
  • Accuracy & Fair Play. We may correct errors, standardize formats, reject incomplete/inconsistent data, and disqualify entries for rule violations (e.g., cutting the course, unsafe behavior).
  • Estimates. VO2max, zones, and predictions are estimates only. They are not medical or professional advice.

7) Photos & Video (Media Consent)

  • Runs may be photographed or filmed. By attending, you give us a worldwide, royalty-free license to use your image, likeness, and voice captured at Runs for community updates and promotion on the Website and social media.
  • Practical opt-out. If you want a specific image removed from our channels we control, email info@team42.ae with the link. We will act reasonably, noting we cannot remove content already printed, cached, or reposted by third parties.

8) Changes, Weather & Cancellations

  • We may change routes/schedules or cancel a Run for safety or operational reasons (e.g., weather, access restrictions).
  • We will try to notify Participants via the Website or via your registration contact details. We are not responsible for costs you incur due to changes or cancellations.

9) Acceptable Use of the Website

  • No scraping, hacking, malware, or attempts to bypass security. Do not interfere with normal operation.
  • Do not upload unlawful, defamatory, obscene, harassing, or infringing content. You must have the rights to any content you submit.
  • We may restrict or suspend access if we believe these Terms are breached.

10) Intellectual Property

  • The Website’s text, design, graphics, logos, code, and data compilations are owned by Team 42 or its licensors.
  • Do not copy, adapt, distribute, or create derivative works without our written permission, except where the law allows.

11) User Content & License

  • If you submit content (e.g., screenshots, testimonials), you grant us a non-exclusive, worldwide, royalty-free license to use it for Runs and the Website.
  • You confirm you have all rights to grant this license and your content does not infringe others’ rights.

12) Privacy

Team 42 L.L.C-FZ (“Team 42”, “we”) respects your privacy. By using openrun.ae you agree to this Privacy section. We collect technical data (cookies, device info, IP, UTM tags), details you submit in forms (name, phone, email, running experience, preferred contact, optional links like Strava), Run data and Results (times, distances, VO2max estimates), and photos/videos taken during Runs. We use this to operate the Website, publish leaderboards/results, improve services and marketing, and contact you about Runs or training. We do not sell your personal data; we may use service providers (e.g., hosting, email) under contract and safeguards. We use cookies for analytics and functionality—disable them in your browser if you wish (some features may be limited). You can request access, correction, or deletion by emailing info@team42.ae; we may keep limited data needed to preserve historical results/leaderboards.

13) Disclaimers

  • No medical advice. Website information (including VO2max, zones, predictions) is general information only, not medical or professional advice.
  • As-is. The Website is provided “as is” and “as available”. We do not guarantee uninterrupted or error-free operation, or completeness of information.

14) Liability Limits

  • To the maximum extent permitted by law, we are not liable for indirect, consequential, incidental, special, punitive, or exemplary damages, or loss of data, revenue, profits, or goodwill.
  • If liability cannot be excluded, our total liability to you for any claim related to the Website or a Run is capped at AED 1,000.

15) Minors

  • Minors may attend only with a supervising parent/guardian who accepts full responsibility for the minor’s safety and compliance with these Terms.

16) Third-Party Links & Services

  • The Website may link to third-party sites/services (e.g., maps, timing apps). We do not control or endorse them and are not responsible for their content or policies.
  • Your use of third-party services is at your own risk and subject to their terms.

17) Changes to Runs, Website, or Terms

  • We may improve, modify, or discontinue parts of the Website or a Run at any time.
  • We may update these Terms. The “Last updated” date shows the latest version. Continued use/attendance means you accept the changes.

18) Force Majeure

We are not liable for delays or failures due to causes beyond our control, including severe weather, natural disasters, acts of government, public health emergencies, labor disputes, or utility/network failures.

19) Miscellaneous

  • Severability. If any part is invalid/unenforceable, the rest remains in effect.
  • No waiver. Not enforcing a provision is not a waiver.
  • Assignment. You may not assign these Terms without our consent. We may assign in connection with a merger, acquisition, or restructuring.
  • Entire agreement. These Terms (including Section 12, Privacy) are the entire agreement between you and Team 42 for the Website and Runs.
  • Language. English controls if there is any conflict with a translation.

20) Governing Law & Jurisdiction

These Terms and any disputes (including non-contractual disputes) are governed by the laws of the United Arab Emirates. The courts of Dubai, UAE have exclusive jurisdiction.
